MARA Code of Conduct


Migration Agents Registration Authority Code of Conduct is intended to regulate the conduct of registered migration agents. It is to be displayed prominently in a registered migration agent’s office and reception area. It is also to be given to a client to keep if he or she asks to see it.  

Code of Conduct (the Code)

The Code details the professional and ethical standards for registered migration agents. The Code is amended from 1 July 2012.  The amended version is now available on our website (see below for more details on the changes and the previous version of the Code of Conduct).

It is legally provided for in section 314 of the Migration Act 1958, and it is prescribed in Schedule 2 of Regulation 8 of the Migration Agents Regulations 1998.

Consultation Paper - Proposed Amendments

You are invited to consider the proposals and to provide your submissions in writing. Should you wish to do so please send your submissions to the Migration Advice Industry mailbox.

The closing date for submissions has been extended to 12 October 2012.

Breaches of the Code of Conduct

The Office of the MARA may impose a sanction on the agent if a breach of the Code is found to have occurred.

Sanctions include:

  • cautions
  • suspension of registration, or
  • the cancellation of registration.

If you believe that a registered migration agent has breached the Code, you can write to the Office of the MARA using the complaints form.

Code Amendments – 1 January 2012

The Code of Conduct was amended from 1 January 2012.  Amendments were made to Parts 1, 2, 3, 5 and 7 of the Code.

The changes allow for the implementation of certain consumer protection measures and include a number of notification requirements to increase consistency throughout the Code.

The changes are in line with the 2007-2008 Review of Statutory Self-regulation of the migration advice profession.

An addendum has been issued to the Code of Conduct (1 October 2006) for insertion into existing copies displayed prominently in a registered migration agent’s office and reception area.
